Backflip Over NSW Coffee Cup Laws Leaves Cafes Relieved

The NSW Government scraps unworkable plastic regulations after intense backlash from local cafe owners.

The NSW Government has executed a dramatic backflip on its proposed overhaul of single-use plastics, abandoning unworkable regulations that threatened to suffocate local cafes across the Upper and Lower North Shore and the Northern Beaches.

The rapid reversal on the NSW Plastics Plan 2.0 came within 24 hours of the NSW Premier appearing on Sydney breakfast radio, where he struggled to clearly articulate how the impending changes would work in practice. The stumbling performance on 2GB Breakfast immediately ignited a fierce feud on Macquarie Street and prompted outrage from small business advocates across the state.

In Short

  • Sudden Reversal: The NSW Government has scrapped unworkable elements of the coffee cup mandate within 24 hours of radio backlash.
  • Takeaway-Only Relief: Busy espresso bars will not be forced to manage and clean customer-supplied keep cups during the morning rush.
  • A Win for Local Business: The backflip avoids placing suffocating red tape and rising packaging overheads on small cafe operators.

The original framework, detailed in the government’s “NSW Point of Sale Coffee Cup changes” reference file, mandated that by 2028, all single-use takeaway coffee cups must be strictly recyclable. Crucially, it also sought to enforce a blanket rule requiring cafes to accept reusable cups – often referred to as ‘keep cups‘ – for all takeaway orders.

That requirement drew sharp criticism from the hospitality sector. Critics and the State Opposition pointed out that forcing busy baristas in high-volume, takeaway-only espresso bars around transport hubs like Chatswood and St Leonards to accept, handle, and potentially wash customer-supplied cups during the morning rush was an impossible operational burden.

The proposed laws were widely condemned as suffocating red tape that would unfairly penalise struggling mum-and-dad operators already grappling with high electricity bills, rising wholesale costs, and broader cost-of-living pressures.

In a substantial win for local business, the government moved swiftly to scrap the unworkable elements of the mandate. The sudden decision removes the immediate threat of forced compliance and higher wholesale packaging costs for independent cafe operators.

Instead of a frantic scramble to re-engineer their morning service to accommodate a flood of BYO cups, cafe owners can now focus on their trade without the looming threat of heavy-handed regulation.

While environmental sustainability remains an important civic objective, this rapid policy retreat serves as a stark reminder of the need for practical, grounded rules that support, rather than disrupt, the lifeblood of our local shopping strips.
