On a sunny, perfect Tuesday morning earlier this year, I was grabbing my usual coffee from a local shop when I spotted Mike hunched over a corner table, staring into his cup as if it held all the answers.

Mike’s one of those people who lights up a room – thirty years building his family’s motor car business into something special. But that morning? He looked like someone had punched him in the gut.

sliding into the seat across from him. He looked up with eyes I’d never seen before – defeated, exhausted. “Con, I’m finished. Thirty-three years in the same workshop, same street. The landlord’s not renewing. I’ve got four weeks to get out.”

My heart sank. I knew exactly what this meant. Mike’s entire customer base knew him at that address. His supplier relationships, his staff who lived nearby, his equipment setup – everything tied to that location. In four weeks, three decades of goodwill would walk out the door with him.

“The landlord’s selling to developers,” Mike continued, his voice barely above a whisper. “Apparently, they can make more from apartments than keeping us small businesses around.”

The devastating truth? This was completely avoidable.  Mike had been on a month-to-month lease for two years. “We had such a good relationship,” he told me. “I fixed his car, never missed rent, even helped him with other cars in the family. I thought I was safe.”

But relationships don’t protect you when money talks louder.

Here’s the lesson that took me decades to learn the hard way. Here’s what I’ve learned from 40+ years of watching brilliant business owners lose everything to lease problems:

Commercial leases aren’t just paperwork – they’re the foundation of your business value. In today’s market, where buyers are cautious and interest rates keep everyone on edge, lease security can make or break a deal.

The Three Lease Pillars That Protect Your Investment:

Term and Options: Smart buyers want certainty. A five-year lease with two five-year options tells them you’re not going anywhere. I’ve seen identical businesses sell for 20-30% higher prices based solely on lease security. One of the first questions a prospective buyer asks me is what is the weekly rent and the length of the lease.

Rent Reviews: Yes, your rent will go up. But predictable increases (fixed percentages or CPI) are far better than “market reviews” that can devastate your margins overnight.

Flexibility Clauses: Build in assignment rights, subletting options, and reasonable notice periods. Future buyers need to know they can adapt without having to start from scratch.

I know what you’re thinking: “But Con, my landlord loves me. We’ve been mates for years.”

I believed that once, too. Until I watched a client lose his restaurant when his “mate” landlord passed away, and the kids decided to redevelop. Or when zoning changes made the property worth more empty than occupied. Or when interest rate pressures forced a quick sale to developers.

The painful pattern I see monthly:

  • Great business relationship with landlord
  • Handshake agreements and trust
  • Lease renewal “discussions” that never happen
  • Sudden notice to vacate
  • Decades of goodwill… gone

Mike’s motor car business? He finally found a new workshop twenty minutes further from his customer base.

It’s been eight months now, and the workshop that used to have cars lined up outside sits noticeably quieter. Based on what I can observe and similar forced relocations I’ve seen in my practice, Mike’s probably looking at $150K-200K in lost annual revenue.

I have clients who have sold the business for a reasonable price and retained the building as a rewarding commercial property investment, in addition to a more comfortable retirement nest egg.
