Traffic offenders directed to court for sentencing can face a range of penalties that may vary at the court’s discretion. Offenders who plead guilty can seek leniency from the court when being sentenced.
The Traffic Offenders Intervention Program (TOIP) is a local court program aimed at assisting traffic offenders who plead guilty to, or are found guilty of, a traffic offence.
The program is aimed at providing offenders with information and skills to develop and enhance positive attitudes toward driving, as well as develop safer driving behaviours. This, in turn, is intended to reduce the likelihood of re-offending.
Offenders that undertake and complete the course are issued a Certificate of Completion recognising their achievement in completing the program. This can in turn be used in the offender’s plea of mitigation to the court as evidence of their good intention and remorse for the offence committed, and seek leniency from the court in their sentencing.
Offenders with drink drive charges can undertake a Speed Alcohol Vehicle Education (SAVE) program, also designed to equip offenders with information and skills to achieve safer driving behaviours. In addition, the Sober Driving Program is a mandatory program available to convicted offenders who have been given an interlock exemption by a court.
